Definitions

The following terms shall have the the meaning herein ascribed to them:

Agreement: shall mean the present Agreement which contains the present Terms and Conditions;

Authorized Service Network: shall mean the Company’s Authorized Service Network devoted to the repair and maintenance of Company’ machines, amongst which the Products;

Company: shall mean CNH Industrial Italia S.p.A., having registered office at Turin, Via Plava 80;

Customer(s): shall mean the Independent Operator(s) which, upon registering on the Site and accepting the present Terms and Conditions, enters into the Agreement with the Company;

Independent Operator(s): shall have the same meaning as per Article 3 of the Regulation (EU) No 167/2013 of the European Parliament and of the Council;

Maintenance Plans Area: shall mean the Company’s area devoted to providing scheduled maintenance information;

Manufacturer: shall have the same meaning as per Article 3(25) of the Regulation (EU) No 167/2013 of the European Parliament and of the Council;

Mechanic(s): shall mean the specialized technician(s) qualified to undertake repairs on the Products;

Spare Part Catalogue: shall mean the Spare Parts software Management Catalogue; 

Party(ies): shall mean the Customer and the Company;

Products: shall mean the CASE IH, New Holland Agriculture, Steyr branded tractors;

Repair Methods & Times Area: shall mean the Company’s area devoted to standard repair times for undertaking repairs on the Products;

RMI Regulation: shall mean the set of European regulations governing the rules for the access by the Independent Repairers to the maintenance and repair technical information provided by Manufacturers;

Services: shall mean the Services offered to the Customer(s) as defined by the present Terms and Conditions which shall consist of purchasing the access to Technical Information and Parts Catalogues, purchasing Special Tools and Electronic Service Tool Licences, and downloading vehicle software;

Site: shall mean the Company’s web Site accessed by the Customer and containing Company’s Technical Information and Parts Catalogues regarding the Products;

Special Tools Area: shall mean the Company’s area devoted to specialised repair tools or equipment that may be required to undertake repairs on the Products;

Technical Information: shall have the same meaning as per Article 53(1) and (3) of the Regulation (EU) No 167/2013 of the European Parliament and of the Council;

Technical Training: shall mean the training to undertake repairs on the Products;

Terms and Conditions: shall mean the present clauses governing the access and registration by the Customer on the Site and the purchasing by the Customer of the Services.

 

General Information

The registration on this Site guarantees on-line access to the Technical Information necessary for repairs and maintenance of Company’ Products.

The data available on this Site are supplied purely for informational purposes and may not be up to date in case of modifications made by the Manufacturer for technical and/or commercial reasons or in case of adaptations required by the applicable laws in force in different countries. 

The repair and maintenance operations of Products described in the Technical Information published on the Site must be carried out only by Mechanics with specialised training in the relevant areas, using the necessary tools and equipment.

Neither the Company nor any other companies controlled, directly or indirectly, by CNH Industrial NV shall be held responsible for the results of any operations and/or activitites performed using said Technical Information as a reference.

Technical requirements for Site access

The Site requires use of the following:

Registration process: connection/access method 

Site registration is required in order to access the Technical Information.

In order to successfully complete the registration process, the Customer shall accept the present Terms and Conditions for use of the Site.

The registration process for Mechanics and Independent Operators mainly requires personal data and contact details to be entered; a password will then be provided which will be used for all subsequent access to the Site.

For the Products, in compliance with Regulation (EU) No 167/2013, Commission Delegated Regulations (EU) 1322/2014, 2015/96 and 2015/208 and Commission Implementing Regulation (EU) 2015/504, free consultation is available in order to check beforehand for the existence of information assisting the Mechanics.

Furthermore, reprogramming and configuration of electronic components and/or control units is available: payment is made on-line per transaction. For on-line transaction-based payments, the prices depend on the type of operation and component: the prices for transaction-based services are available in the relevant section.

Access to the Technical Information is possible by purchasing one of the available subscriptions (choice of varying durations), which starts only when activated by the Customer. Subscription length depends only on the type of subscription purchased and is independent of the number of times the Site is accessed.

Notwithstanding the above, it is hereby expressly understood that if the user 

·  does not activate the subscription; or

·  does not make use of the purchased transaction-based item within a specified time limit expressly set forth below (see Terms and Conditions),

 that subscription and/or transaction-based item shall expire and no refund of any type shall be due to the user.
